on Dowry Death Law
A dowry death occurs when a woman dies within seven years of marriage under unnatural or suspicious circumstances, and it is established that she was subjected to cruelty or harassment by her husband or his relatives in connection with dowry demands. It is covered under Section 304B of the Indian Penal Code.
The punishment under Section 304B IPC is imprisonment for a term not less than seven years, which may extend to life imprisonment, depending on the severity and circumstances of the case.
Dowry refers to any property, money, or valuable security given or agreed to be given directly or indirectly by one party to a marriage to the other party or their relatives, in connection with the marriage, as defined in the Dowry Prohibition Act, 1961.
While both relate to cruelty by the husband or his relatives, Section 304B (Dowry Death) applies when cruelty or harassment leads to the woman’s death, whereas Section 498A covers non-fatal cases of cruelty and harassment for dowry or other unlawful demands.
Anticipatory bail is rarely granted in such cases due to the serious nature of the offence. However, it may be considered in exceptional situations if the accused can establish lack of involvement or false implication.
The victim’s family members, relatives, or any person aware of the offence can file a complaint or request investigation. Police often register a case upon receiving information about unnatural death within seven years of marriage.
